Terms of Service

By accessing or using attractmedia.ai (the "Site"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, do not use the Site.

These Terms govern your use of the Site as a visitor. Separate written agreements govern any contracted services provided by ATTRACT Media Inc. In the event of a conflict between these Terms and a signed services agreement, the signed agreement governs.

ATTRACT Media Inc. ("ATTRACT," "we," "us," or "our") is incorporated in Saskatchewan, Canada, with its primary office at 1107 Pohorechy Crescent, Saskatoon, SK S7W 0H9.

You may use the Site for lawful purposes only and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates applicable federal, provincial, or local law or regulation.
• Transmit any unsolicited or unauthorized advertising or promotional material.
• Attempt to gain unauthorized access to any portion of the Site or its related systems.
• Use any automated tool to scrape, crawl, or extract content from the Site without our express written permission.
• Impersonate ATTRACT Media Inc. or any employee, contractor, or representative.
• Transmit any material that is defamatory, offensive, or otherwise objectionable.

We reserve the right to terminate access to the Site for any user who violates these Terms.

All content on the Site, including but not limited to text, copy, headlines, case studies, article content, design, graphics, logos, video, animation, and the overall look and feel of the Site, is the intellectual property of ATTRACT Media Inc. or its licensed content providers and is protected by Canadian and international copyright law.

You may not reproduce, distribute, modify, publicly display, or create derivative works from any Site content without our express prior written permission.

Case study content referencing client work (including Cherry Insurance, W Law LLP, Northlands College, and others) is published with client consent and remains the intellectual property of ATTRACT Media Inc. or the respective clients as applicable.

The portfolio, case studies, and client work displayed on the Site represent completed projects produced by ATTRACT Media Inc. Individual deliverables remain the property of the respective clients under the terms of their service agreements with ATTRACT Media Inc. Display on the Site constitutes permitted use for marketing and portfolio purposes.

Content on this Site describes past results achieved for specific clients in specific market conditions. Past results do not guarantee future outcomes. Marketing results depend on a wide range of factors outside ATTRACT Media Inc.'s control, including but not limited to market conditions, competitive activity, budget, client participation, and platform algorithm changes.

Nothing on this Site constitutes a guarantee, warranty, or representation of specific outcomes for any prospective client.

The Site contains links to third-party websites and platforms including YouTube, LinkedIn, Instagram, Facebook, X (Twitter), TikTok, and client websites. These links are provided for convenience and do not constitute endorsement of the content, products, or services on those sites. ATTRACT Media Inc. has no control over and accepts no responsibility for the content of third-party sites.

The Site and its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

ATTRACT Media Inc. does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or timeliness of any content on the Site.

To the fullest extent permitted by applicable law, ATTRACT Media Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Site, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of your use of the Site shall not exceed one hundred Canadian dollars (CAD $100).

Nothing in these Terms limits liability for fraud, gross negligence, or willful misconduct.

These Terms are governed by and construed in accordance with the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Saskatchewan.

We may revise these Terms at any time by updating this page. The revised Terms will include an updated "last updated" date. Your continued use of the Site following any revision constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy and any signed service agreements, constitute the entire agreement between you and ATTRACT Media Inc. with respect to your use of the Site.
